Your use of the Performance Lighting web site is governed by the policies, terms, and conditions set forth below. Please read the following information carefully. By using this site or submitting an order for products or services, you indicate your acceptance of, and agreement to be bound by, the terms and conditions set forth below. These terms and conditions may be changed without notice by Performance Lighting, Inc. in the future. It is your responsibility as a user to periodically return to this page to review the terms and conditions for amendments. The amended terms shall take effect automatically the day they are posted on the site. Your continued use of the Performance Lighting web site following any amendments will constitute agreement to such amendments. These Terms of service were last revised on January 12, 2011.
Products:
Items are generally shipped as available; however, Performance Lighting may discontinue any product at any time without notice. In this instance, you (the buyer) will be notified as soon as we are notified by the manufacturer or the broker. Performance Lighting will contact you to let you know when the backordered items will be shipped. Performance Lighting has the right to substitute an item of equivalent specifications. Once we have accepted the order, Performance Lighting has the right to mix brands on an item to fill the requirement of the order. The product prices displayed on this site do not include shipping, handling or sales taxes if applicable.
Sales Tax:
You (the buyer) are responsible for the payment of any state and local sales or use taxes that may apply to your order. The sales tax is calculated based on the full invoice price, and may include charges for shipping and handling if required by law. We will collect the sales & use tax for the order from the State of Texas.
Substitutions:
Performance Lighting reserves the right at any time to substitute items meeting or exceeding the specifications as listed in the description of the item. Performance Lighting may substitute items to avoid a lengthy backorder, replace discontinued items and maintain the displayed prices. Performance Lighting will substitute items of equivalent function, quality and similarity of use.
Return & Restocking Policy:
While Performance Lighting strives to make sure you are 100% satisfied with your order, occasionally there are errors that need to be corrected.
Performance Lighting stands behind its products and will issue a refund, replacement or credit if you are not satisfied with your purchase and notify us within 5 days of receipt of product. A restocking charge of 35% will apply to all items returned where Performance Lighting has made no error in order fulfillment or shipping. Arrangements and the cost of returning items to Performance Lighting, Inc., are the responsibility of the customer. Shipping and handling charges are prepaid and are not refundable. Refunds will be made by original method of payment. Only new unused items in their original undamaged containers will be considered for return. All freight charges for the return of goods are to be paid by the customer. No returns on clearance and closeout items.
Please contact Customer Service to obtain a Returned Material Authorization (RMA) before returning any product. Performance Lighting may at any time limit the number of delivery attempts based on unfavorable delivery history resulting from, but not limited to, damage, loss, or theft.
Pricing:
Prices displayed on Performance Lighting's web site apply solely to orders placed on our web site. If product price errors are discovered, we make every effort to promptly correct those in our system and on our web site. We will notify you if your order includes items that are incorrectly priced. However, please note that prices are subject to change without notice. In the event of any price increases you (the buyer) will be contacted for approval prior to processing any order. We will also notify you if your order includes items that were incorrectly priced. Performance lighting will not accept the order until pricing issues have been corrected and you (the buyer) have been notified and have accepted the new pricing in writing.
